Report this. I do not believe this to be a legitimate business or collection effort. These people called my mother to inquire about my sister and some bad debt. Basically they told my mom that if my sister didn't settle up her debt in 1 hour, they would "file a warrant for her arrest." I called them back as I am a licensed attorney in the State of Minnesota. Number 1 - a law firm, attorney or collection agent has no authority or ability to "file a warrant for an arrest." This must be done by the County/District Attorney - OR the State Attorney General's office. This is a mere threat by this company to try to get people freaked out over the idea of a warrant in order to induce them to pay. I dealt with this "Tory" individual when I called, and basically told him that I was an attorney (gave him my name and license #) and explained that he and I both knew they couldn't do what he was suggesting. He told me that he deals with "scum of the earth" every day and "at least he has a job and dont write bad checks" - implying that my sister did. Bottom line is that IF in fact this was a legit deal, there is an entirely different set of protocol that they should follow. A person whom has a bad debt against them should be sued, and a judgment would be entered against them if the collections company was successful. THEN, they can move to garnish wages, etc ... a debt collection company or attorney cannot themselves decide to file criminal charges in anyway - this is not their call. Nor is it usually enough of a big deal that any District/County Attorney or State Attorney General would review the case then elect to file charges (especially when dealing with such small dollar amounts and such a long passage of time). Either way if you get a call like this - tell them to do what they must, but do not settle up with them. They can make their threats but it is unlikely to amount to anything. If it were me, I would rather take my chance by dealing with a bad debt the legitimate way - in Court - than by agreeing to give these unprofessional people a dime - especially given their method of collection ... threats that they cant even follow through with. Good luck.
