This is probably over a Gold's Gym membership my husband and I signed up for but were never able to utilize. The local GG was to open last January (2011); but the opening kept getting pushed back for seven months, and finally opened in late July or early August of last year. I believe this to be a breach of contract and I should not be held accountable; the new members, such as myself, were NEVER notified of the delays in a timely manner, and in some cases not at all. More often than not, I found out about the delays via our local newspaper.
Because of a change in our financial status, I contacted GG shortly before they had opened and inquired about cancelling. I was told that I had no choice but to continue with the contract, even though 1) the gym had not yet opened, and 2) I had not yet made any payments towards the membership. As of right now I am still trying to locate the paperwork we signed; but I have, in the past, requested written verification of this debt from this shyster lawyer's office, and have not yet seen a THING from them. Yet they have no problem whatsoever calling me, do they? *smh*
I am now going to send them another certified letter instructing them to cease and desist IMMEDIATELY, as is my right under the FDCPA. Thankfully I do not have to endure numerous harassing phone calls, thanks to my DECT 6.0 phone which allows me to put their number on call block...hehe...
