this company uses highly illegal collection tactics. I worked in the industry for a good amount of time recently so I know a bad collection company when I hear it. Real old account way past the statue of limitations plus I disputed. because it was fraud popped up with this agency. They left an illegal message on my house phone indicating I'm getting sued. Then saying its in regards to collection of a debt. it is well known these messages need to be structured a certain way otherwise its illegal if someone hears it other then you or if it indicates false information/misleading information. I called back and Mike Friton claimed a lawsuit was filed against me. he said i committed fraud when i didnt pay the bill without ever asking why it wasnt paid. highly illegal.
Never verified who I was or even gave a mini miranda or indicated it was a recorded phone line (at least he didn't say it was untill the end which is illegal per federal wire tapping laws). So I sent the message and a description to my lawyer and we should be filing suite and then I'm reporting to the CFPB (consumer financial protection bureau). Mr. Fritton might not have to pay but ill make sure the owners of the company are pointed out for fraudulent collection practices. I kind of hope they don't pay after the verdict so I can request a sherriff come out and start pulling company property for an auction. Anyone want to buy a slightly used cubical.
Also I worked in the industry and was successful without ever giving anyone a hard time like that. Collectors like this really make it hard for those trying to make a living in that industry while doing it the right way. If someone cant pay or claiming fraud id just educate them the best I could so they could make an informed decision. Then if there was still an issue I would wish good luck and move on. Thanks to you guys I now know where they are out of and know NY has very strict collection laws so.i feel this company is looking at more then just a simple FDCPA violation pay out.
