Received a call at work from a Mr. Diaz.  Very nasty.  Said I have an unpaid payday loan and my wages would be garnished if I didn't take care of immediately.  I tried to explain I could not take personal calls at work and get his number (pulled off caller ID).  Mr. Diaz immediately became nasty and told me that because I was playing hardball he was going to hangup and call my HR dept.  I got him to calm down and he put an "attorney" on the phone.

The "attorney" claimed my wages were about to be garnished.  I finally got him to give me the supposed payday loan company name - which I never heard of.  I thought it might be a scam but he had all my personal information.  This is the first I heard of this unpaid payday loan.  Claims multiple certified letters have been sent to me.  When I asked for proof, he claimed they were all returned undeliverable.

The "attorney" is supposedly going to email me all of the pertinent information.  I guess we'll see.  Regardless, I don't think my wages can be garnished without a court order.

They can only garnish your salary with a court order and more than likely they won't even try or they will not be granted the permission to garnish your wages. Do not give him any information. I would ask for the mailing address to send a certified letter. Here is an example letter you can send them:

To Whom It May Concern:

This will serve as your legal notice under the federal Fair Debt Collection Practices Act
(FDCPA), to cease all communication with me in regard to the debt referenced above. Do not contact me, or any third parties regarding this debt via the telephone.

Furthermore, I formally dispute the validity of this debt. Please provide me with documentation that supports why you believe this debt belongs to me, and why you believe I owe this amount. Please send me copies of the original application for this account, any signatures associated with this account, any bills associated with this account, etc.

You are also notified that should any adverse information be placed against my credit reports, appropriate actions will be taken under the federal Fair Credit Reporting Act (FCRA).

Thank you for your attention to this matter.

Make sure you pay the extra amount for the return receipt and make a copy of the letter so you have proof that they received it. If they fail to comply then you can sue them for violation.

Does anyone know who this company is?  Despite my verbal demand that they stop calling me at work, their number shows up on my caller ID at least once a day.  Their "attorney" promised to email me with the details of my debt and said he'd follow-up with a letter, that was a month ago, and I've received nothing.

I want to send them a Cease and Desist letter as well as file formal complaints with the FTC and AZ Attorney General, but can't do that until I can figure out who they are.

I got a call from some nasty guy who started off the conversation with your wages are going to be garnished. I said wait a minute who is this and for who? He said for Quick Cash in 2009 you owe around $700 or something like that??? That's what he said, he didn't even have an exact amount. I said well I've filed bankruptcy so you can contact my lawyer and he proceeded to scream over me not getting my lawyers info. I finally said well I don't work so garnishing my wages is impossible. He proceeded to call me a loser on and on so I said actually no! I'm a nurse, I have cancer and this is why I had to file bankruptcy because I am too sick to work. I hung up on him. He called back from a 561-869-4490 and said I'm going to die a painful death and this debt is why God has punished me with cancer and that I will burn in hell! I tried calling back because I will be telling his boss about this. I hope he ends up with no job! $700 is sure not a reason to treat someone like this!

These people are scammers.  They have been calling me for over a year now.  They have threatened to kill me, my family, and co-workers.  I have filed numerous complaints with the AZ attorney generals office, FBI, and FTC.  They threatened to "cap" me like the congresswoman here in AZ.  I immediately filed a complaint with my local police department.  They continue to call.  Finally, I have become just as rude and nasty towards them (which is NOT like me).  I tell them to come and arrest me - put bring fuzzy hand cuffs.  I also tell them to go back to driving their taxi cab and eating their rice and curry - leave me alone!!
