Never will happen, and nobody should be surprised. They sell magicJacks in India for about $100 US, and telemarking scams are viewed by the government there as legitimate jobs. So they just hang out in their mother's basement calling the US for free on a magicJack they saved up to buy for the purpose of scamming US citizens out of big money.
Of course, if you complain to the right people (e.g., the Department of the Treasury and your state's Attorney General, and perhaps YMAX Corp., the captive company that gives out magicJack numbers and whose terms of service are being broken, you may have some luck. MagicJacks can be permanently disabled (albeit only one at a time) by YMAX or magicJack based on a complaint like this.
