I get several calls a day from this number regarding a check they say my husband wrote 21 years ago.  We have only been married 9 years so how is that check associated with my cell phone number which is in my name.  Scam alert!!!

Got a call from this number saying to press one before they take action against me. It is truly a fraud.
I have NEVER in my life written a bad check. I am not married so no wife to write one. I did not answer, but the message on Caller I D said to press one. I did not. They claim to be from some shyster lawyer.

Keeps calling me about a fraudulent  check. Said it was some law office.  I finally answered after I got tired of them calling. Said a wrote a bad check. I asked why my bank wouldn't have contacted me about it. I've banked with the same people for 29 years. I've never received a notice of any bad check. In fact I have it set up so my checks would be covered even if I had insufficient funds. I screamed and yelled for awhile and then hung up.

Since they talked to you, they must now do this:

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

They won't of course which is why you need to learn your rights and file a report on their criminal activities.  Start here:

Read up on your rights here and also make a complaint at this government site: http://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.
